okay me and my boyfriend were in a car accident almost three years ago. my boyfriend has recently received two letters stating that they lawyer we have can no longer represent him. this was about three days ago. i received a phone call today asking me to come into his office 2morrow. what could this be about?

It could be for any number of reasons:
-if you owe any payments, the lawyer may be requesting them. Or, by contrast, if the lawyer overlooked an aspect of your case when he took it (eg. Conflict of interest), they may actually refund the retainer fees you paid

-he could be re-instating your case if new details have emerged

-he could have other information or releases he needs you to see/review/sign

What I’d suggest is to call the lawyer’s office to see if you can find out exactly why you are asked to attend if the lawyer is no longer representing you; for all we know, the call may have just been erroneous.

Do I need a lawyer for car accident injury?

I had a car accident involving 4 cars including mine. All other cars’ airbags went off while mine didn’t. And my car has the most damage!

Since the airbag didn’t work and my seat belt didn’t lock, I was almost thrown to the passenger seat…and ended up in emergency care.

My friends told me that I need to talk to a lawyer for the airbag and seat belt problem with my car. Should I find a lawyer for this matter?

1st off, like the other answer said, who is at fault for this accident?

If you are at fault, then your insurance company will be liable to the other 3 cars damages/injuries.

I am sure others will tell you that depending on the vehicle, make, year etc is reason for your airbag and seat belt problems. If there is a problem with your seatbelt/airbag, need to consult manufacturer to see if any recalls. A friend of mine who was a claim adjuster hit a tree and the seat did not lock and could not get answers.

Lawyers rarely===rarely handle any airbag/seat belt issues; if they do, they will most likely charge you per hour to research.

If even you hire an attorney for your injuries, they will most likely tell you to research or pursue yourself.

Also; if;;;;;;you are at fault for this 4 car accident, no attorney will handle, since they cant collect for your liability. If you went to the ER and no further treatment, no need for a lawyer.

Let your insurance company handle. If you are not at fault and only had ER treatment, then the other company will offer an injury settlement. If you get a lawyer, they will settle with the lawyer, but might take at least 6 months to settle. And believe it or not, most likely you will receive less due to the 1/3 the lawyer takes.

Ie; ins co offers $500; to you
ins co offers $600 to lawyer; which means you gent $400, lawyer gets $200;

Father of Five Innocent Drunk Driver Victim

On June 28, 1998, Todd was planning to take his family to Lake Powell. He was getting the boat ready for the trip when he discovered he needed a part. He left on his motorcycle to buy the part. He waved to his family as he drove down the street. Little did he know it would take him nearly three months to get home to his family again. His life was about to change dramatically.

Todd stopped at a red light on 39th South and 5th East in Salt Lake city, Utah. A truck traveling about 40 mph slammed into the back of Todd and his motorcycle. His helmet flew off. His head slammed against the hard hood of the truck. Todd was then pushed through the intersection. Fortunately, the driver of the truck swerved and went around Todd. The driver of the truck was drunk. His a blood alcohol level was .28, more than three times the legal limit.

Todd was flown in an emergency medical helicopter to the University of Utah Hospital. Todd sustained a traumatic brain injury. He had a blood clot the size of a fist on the right side of his brain. Todd was taken to surgery to remove the blood clot. Doctors did not think he would survive the surgery. But, if Todd did survive, doctors felt he would probably spend the rest of his life in a vegetative state. Todd spent 5 weeks in a coma, then another 6 weeks in rehab.

Today, Todd is doing better than anyone ever expected, but his life is so very different. He had a successful law practice which is gone because he is unable to work due to the brain injuries sustained at the crash.. He has severe memory and initiation problems.

Todd is the father of 5 young children. At the time of the crash their ages ranged from 9 months to 14 years old. He once was the Dad who would take all the kids and friends boating and skiing, or volunteer to be their soccer coach. Today, he struggles to have a relationship with them because of his brain injuries caused by a drunk driver.

Todd was a successful lawyer. He lost his job because he longer has the intellectual ability to be an attorney. He lost the home he and his wife built because he lost his job. His wife went to work to support the family. She has lost her best friend because he is unable to express himself like he use to.

You can type in ” automobile accidents” or “fatal car crash” or something like that and they will have plenty of articles for you to choose from.

Should I hire a auto accident lawyer?

Yesterday I was involved in a 5 vehicle auto accident. I was waiting at the stop light to turn left and a truck and a motorcycle collided in the intersection. The motorcycist flew up in the air and landed funny. The truck kept going and I noticed how fast it was going towards me. It hit my car head on and pushed my car back about 1.5 car lengths in a 90 degree angle. The truck bulldozed into a nissian truck and GMC Yukon. Obviously from the photos, it proves that he was going at a fast pace because of the damage and for pushing a still object that far.

The motorcycist may have passed away and crime scene detectives arrived to photograph the area. The road was closed and traffic was detered. My car suffered extensive frontal damage and my radiator was cracked in half. I suffered no fractures, but I am very sore today. I went to urgent care and the doctor told me to see my PCP to have her review if I should see physical therapy.

My friend suggested a lawyer because the accident could be manslaughter and because one party hit 4 different cars. I believe my car is totaled and I will be sore for a while. To this extent, should I hire a lawyer because of the occurance and because the driver at fault’s insurance might try to screw me over because they have to pay for 4 parties cars, and maybe a wrongful death suit.

If so, would the lawyer make sure I get compensated well for my totaled car? I know this is going to be a huge inconvenience.
It wasn’t about making a profit, I am worried that I will lose out on a car or not get paid enough to purchase a new one. I just bought it 2 years ago.

I would wait a little bit to see what shakes out the lawyer will get one third for something you may be able to do yourself. You have quite of bit of time before the statue of limitations runs out on a lawsuit

The exact language on Carfax is:

Accident reported
Vehicle involved in collision
with another motor vehicle
Vehicle functional”

Does this mean they drove away after the accident? Is it safe to assume this was a minor accident?

Doesn’t mean it was a minor accident, but it does mean that the vehicle was driveable and they drove it away from the accident. Functional in that context means able to drive, it functioned. That doesn’t mean it didn’t fall apart after it got off the road. And it could also mean it was just a fender bender with limited damage. If there was a report made, the damage to one of the vehicles was substantial enough to file a report.

I was at-fault in a car accident, and didn’t receive a citation. Will this appear on my motor vehicle report?

I am applying for employment with a company, who will be checking my motor vehicle report/driving record. I want to know if no citation was issued, though I was at fault, if this will still appear on the report.

Yes, it will show up under the accident reporting agency for your state. Even though you were not cited, you were involved in the accident, insurance companies assess responsibility values or percentages, citing the fact that all involved in an accident had some responsibility. I once worked for the State of Washington in the accident processing section. We would read accident reports issued by the law enforcement or insurnace companies. An employer can go back 3yrs on your driving record, they do not see all of the info, however, a very good deal of it. If you have an alcohol related occurance on your license, they can request info going back ten years.

If you have a minor at fault accident and it was not reported to police in such cases insurance companies always report to DMV and it goes to your motor vehicle report and can it affect getting a job or promotion?

No.
Insurance companies report to a database shared by them. They do not report to law enforcement.
Your DMV driving record and your CLUE report (this is the insurance database) are separate.
I would be pretty shocked if your employer were to check CLUE, and even more so if they were to hold a minor at fault accident against you.

I was involved in a motor vehicle accident and the other party is trying to get me to pay a ridiculous amount!

The accident was minor, I lightly backed into the back bumper of a “NJ access” vehicle (possibly a state vehicle). We exchanged insurance information and the police came and filed a report, it says “minor damages” to the vehicles. I saw her bumper, it was barely any damage if any. I thought the situation was over until I heard from a “third party” agency that is contracted to handle claims for the vehicle owner. They are attempting to get $700. They sent me an estimate in writing and it sounds crazy. There is no way there is that much damage. I told her this and I “bargained” her down to $600, which is fishy! What can I do here? I ABSOLUTELY cannot get insurance invovled because of prior accident history and other factors. If I don’t pay I’m afraid I will get sued. Do they legally have to get a few estimates, perhaps one at a body shop of my choice? What course of action do I have here? Can I make them get another estimate?

Having done autobody work over the years… $700 for a minor bumper damage sounds about right. Have you ever watched any of the videos for the insurance institute crash test system. The 5mph bumper tests have show to cause upwards of $5,000 in damage to some cars.

Basically if you hit the person, and choose not to turn it into insurance then bite the bullet. I am not trying to be a jerk but it sounds like you shouldn’t even be behind the wheel of a car based on the statement of prior accident history. How many accidents have you had?

Be glad they haven’t turned it in to theirs or your insurance company. If you got them down to $600 pay it and be done. Just remember this the bumper cover alone on most cars runs about $500. On my car it is $850 and that is an unpainted cover, add labor for prep and paint it would be an easy $1200 repair.

Where do I find data on traffic accidents that all happened on a certain road, during a certain season. Where is such information kept? Police department? State of Michigan somewhere? Accident reports, etc?

I want to specifically check a certain date last winter and see how many accidents happened that date (as a result of a lot of snow) on a 14 mile stretch of road I travel often.

Does my friend have a case? Michigan Car accident?

My friend just had an accident. He had a green light and the car on the other side just turned left (which is in front of my friends car) ,, therefore my friend hit the car .and was in the hospital for 2 and 1/2 days. IN the police report, the other driver was at fault… The other driver got the ticket. The thing is, even though he had MRI and was informed that it was negative, but after he got out of the hospital he is still experiencing neck, back pains and numbness on his extremities. Plus there is a possibility that the traffic light might have been defective causing the accident, causing the other driver to turn left. The light has 6 seconds only to turn from green to red, these new lights are connected to these camera sensors.. any suggestions or advice are highly appreciated.

Green doesn’t mean “hurl your car into the intersection without looking.” It means “proceed when safe.” Your friend certainly holds some responsibility here.

If your friend is still in pain, he should see a doctor.

How can a police officer have a drawing of an accident on the report without actually seeing what happened?

On my police report is a drawing of what the officer thought happened, which was what the other person involved in the accident had told him. I wasn’t given a chance to explain. How is this fair?

Background info: I was merging onto a “merge lane” (leaving a resturant driveway) on a one-way highway. The other driver crossed over 2 or 3 lanes of the highway. She was headed for the same merge lane to enter the next ‘driveway”. I understand that the cop would write me the ticket for “failure to yield”, however, in the Michigan Traffic Code, there are stipulations to this violation, including not having enough time to stop due to hazardous driving on the other parties fault, etc.

How can he draw this picture without actual evidence. It shows where the crash between our cars occured, but it did NOT show the correct directions of which are cars were headed. (And it was barely an accident- we seriouly just bumped.)

I got into a car accident, what are my responsibilities?

I was in a car accident almost four months ago. I was driving home from school and the car in front of me braked quickly and, due to the fact that it was raining, I didn’t have time to stop. I simply clipped the corner of the car, and some of the paint from my car had scraped off onto it. We called the police and it was noted that the accident was my fault. I accidentally gave the officer an expired copy of my insurance (I had the current one), but he told me not to get it and that it wasn’t a problem. I didn’t get a ticket, we exchanged information (I live in Michigan – which is no-fault), and both went home.

Now, four months later, I received a letter in the mail from a law office claiming that I need to contact my insurance company, and that my failure to provide this information to my insurer may result in a lawsuit.

I’m confused. I called my insurance company the day after this happened and informed them about the accident. My insurance agent told me that the woman I got into the accident with would call my insurance company directly, and that they would inform me if she called. So I’m confused why I’m getting a letter telling me to do her work for her? Isn’t it her responsibility to contact my insurance company, not mine?

The letter itself is riddled with grammar issues, says it contains a “traffic crash report” that wasn’t in the envelope, and lists the wrong insurance company as mine. I’m assuming they’re simply trying to scare me, as there’s a box at the bottom of the letter that I can tick and return that says “I had no insurance on the date of this accident.” So, I’m assuming they thought I didn’t have insurance. Now, I was told that day that I could contact the city police department for any questions regarding the accident, so I’m assuming she can also contact them and get my correct insurance company?

I’m wondering what my legal obligations are. I reported it to my insurance company, am I entitled to more than that? Thank you for any suggestions.
I’m looking for details from someone who is familiar with legal issues. Thanks.

It’s your responsibility to give them your current insurance information, since you didn’t at the time. Do that, and you’re covered. Inform your agent what happened as well. It’s not rocket science.

Type in something like Dangers of a car accident, how to avoid a car accident, or what is a car accident, etc. . When you are done, it will give you several pages of information on articles dealing with car accidents.

I just wrote a paper on this for cognitive psychology. Go to Google Scholar … And type in text messaging and driving and you will find a lot of scholarly links that will help you out.

One of the most interesting facts I found was that texting and driving slows your reaction time to that of a 70 year old attentive driver. Its a startling fact.

What should i do in a no fault auto accident?

A few days ago, i got into an car accident. The situation was that I entered an intersection to make a left turn. The light was green. I waited in the intersection to make the left turn, yielding to oncoming traffic. While waiting the light went from yellow then to red. After the light turned red i went ahead with the left turn to get out of the intersection.An oncoming car ran the light and hit me. When the police came, NO citation was issued to either party. Reason being the other parties unclear description to what happened. As far as i was concerned we were both going to take care of our own cars. The other parties insurance company then called me a few days later informing me they were making a claim against me and the accident was my fault because i ” failed to yield”. I was then instructed by my insurance agent to file a claim to protect myself. The problem with this whole thing is there was no witnesses on the light colors during the accident. I was told in that case the insurance companies go off of statistics. Which in that case most of the time the person making the left turn is at fault. I want to know if there is anything i can do? This is my first accident and i would really appreciate some advice.

Tell your insurance claims adjuster your version of the facts. Depending on which lane the point of impact happened, you may have less fault than the other driver. Just because the other driver had a green light, they have the duty not to enter into an intersection until the intersection has been cleared and it is safe to enter the intersection. ALWAYS try to get a witnesses information when ever you get in an accident if you have any. Otherwise it is word against word, BUT you will most likely have a portion of the blame for the person turning left usually does own most of the blame.

I know this sounds like an awful idea but my son has a death wish and I don’t think he understands it. He was inches away from getting hit by a car going 30MPH. Literally inches and he had the nerve to call me a bitc’h for yelling at him to get out of the street and making him come inside. I want him to see what can happen to him. I want him to learn from others mistakes before it happens to him.

Please be aware: showing your child photos or videos of violent accidents, etc., under most state laws in the U.S., falls under the same laws that cover showing sexually explicit materials to a minor. Either case, if discovered by Child Protective Services, could result in criminal prosecution, loss of custody and/or jail-time. I recommend you find another way to get through to your child.

My recommendations: take your child to a traffic safety course for children. Inquire at your local police department, highway department, and/or Department of Public Safety. Any or all of these should have videos and there should be specialists in childhood education who can explain traffic safety and its importance to your child.

I would also like to encourage family counseling for you and your child to help reestablish your roles as parent and child so that in the future (a) YOU will have a better idea of productive ways to help your child, and (b) your CHILD will learn to respect you and respect your authority. Check your yellow pages for family counselors under ‘counseling’ and/or mental health (I realize this isn’t a mental health issue, but a lot of child psychologists and family therapists also help with these kinds of things)

Since you did not provide the state you live in, it is hard to answer. In Indiana, if damages are more $1000 or more, you are required by law to fill out an SR22 form. Either the police officer making the report, insurance company, or DMV will provide you with this form.

You fill out the form and send it into the DMV. You will not have any marks on your driver history nor should it show up on your driving record.

Now, what is going to make your insurance go up (maybe) is you putting the claim in to your insurance company.

How does filing a No Fault motor vehicle claim in New York State work, especially when it’s your fault?

I was in an accident tonight that was clearly my fault. Everywhere I read online tells me to file this No Fault claim through my insurance company within 30 days, but I’m not sure if I should since it’s my fault?

The back story:
The accident was at night while driving through a road work lane shift (but the road was not actively being worked on at that moment.) I was so focused on the lane shift that when it ended, the road was so wet I couldn’t see the yellow line to get back into the road pattern. I found it, but unfortunately too late to notice the red light – which I braked for but didn’t stop in time. I hit a car that was crossing the intersection and though the driver and passenger were taken to the hospital to be checked for injuries, the officer did not ticket me. Both cars were towed away.

I have 29 days to file this No Fault claim. I have not spoken to the other insurance company but I’ve reported it to mine. How does No Fault work – is it beneficial to file when it is clearly my fault? What are the pros and cons? I’m also clearly worried about being sued for injuries: even though both people in the other car said they were fine they clearly chose to get checked out for a reason. How would No Fault protect me in that given scenario? (I’m reading that they can’t sue for total costs less than $50,000.)

I’ve yet to see my car (though probably totaled) in daylight and I have to pick up the police report tomorrow. My insurance includes collision, but is it wise to ask my insurance company about the No Fault form? Does anyone here have experience with it and how it works?

I’ve never been in an accident like this so any advice would help tremendously.

There is a lot of confusion on this point.
New York No Fault coverage is a first party medical coverage. Filing a no fault claim does not affect the liability decision of the insurance companies.
If you or anyone in your car is injured, by all means file a No Fault claim, and it will cover your injuries.
The insurance companies will do an investigation and determine who is at fault.
Many people mistakenly think this term means that you have something in your policy that protects you from being found at fault and this is not the case. The medical coverage is simply called “No Fault” because it pays regardless of fault.

I want to find more about VIC and if I can drive without document? even if the car is it in my name.?

I don’t know what to do. Can someone HELP me please? I have a VIC required on my car and I don’t have any documents because they can’t sent me V5C until I apply to the Vehicle and Operator Services Agency (VOSA) for VIC, so can I still drive the vehicle without any documents even DVLA has updated my details as current keeper on their records? THE PROBLEM is I had a little accident and I receive that MOTOR ACCIDENT REPORT FORM from my insurance company, which I have to fill it and send it back with a copy of my driving licence and a copy of the V5 document for my vehicle which I don’t have it. So PLEASE what should I do now, can I send without V5 document or PLEASE any ADVICE how to resolve this.

Without the VIC you cannot get the V5C and you should not be driving the car on the road. You need to tralier it to the VIC

How do I prepare to go to traffic court to defend my case?

My license was suspended without my knowledge back in November 2006, and I live in Tampa, FL. The reason it was suspended was because I had mailed a speeding ticket payment, and because of mail delays, they did not receive my payment in time and therefore suspended my license without my knowledge. I got into a car accident, and the cops found out my license was suspended and took it away. The next day, I received a letter from the DMV stating that my license was to be reinstated. I’m going to court to get the citation lifted, how do I prepare myself for traffic court? Never done this before.

First call the post office to see if there were any bad delays at that time in the holidays.

Next type up your statement and sign it.

Now have someone else drive you to the court. Wear a coat and tie, look quite business like, fresh haircut. Be very polite. Always call the judge “your honor”

Hand a copy of your statement to the court recorder when you enter or are called.

Apologize for not being aware of the slow mails at that time.

The court likes to see people taking the court system seriously, and is willing to be a bit more understanding if you look serious.

Have you ever encountered a state or city in which people drive much too slowly. As in dangerously slow?

I’ve seen it here in Florida. Every day. One should not be doing 55 in the left lane in a 70 mph zone. The state senate (with the backing of major police associations) actually passed a bill to outlaw slow driving in the left lanes here in Florida because the problem has become so bad. Jeb Bush vetoed it. Also, the problem is ridiculous on the city streets here in the Tampa Bay area also. When people mess up the flow of traffic and create big packs of cars, accidents happen. Ever seen a NASCAR race where a huge pack formed? Like at the start of a race? BAM! Accidents! Cell phone users drive especially slow here.

In PA the normal speed limit on the highways is 65. Anyone going 55 or below must turn on their 4 way blinkers.
