Well it appears there is; I was watching Phil Gordon back peddle when asked why the Phoenix PD is not allowed to question the status of citizenship when a suspect is detained. He kept claiming that they do ask. I remember an article you posted about sanctuary cities, it is being denied by Phil, but it is kinda in print. What to believe these days.

Are you telling me that this little boy, his name was Daniel Valerio, would not have been better off if he had not been born? Not everyone is kind . Not everyone knows how to be a parent and not everyone is willing to go down the adoption route. I I don’t know how anyone could look at his bruised & swollen little face and say to him “well, at least you weren’t aborted”. How is a short life full of pain and torture preferable to not being born and not suffering any pain

Why does everyone think we need to worry about Animal Rights?? How about Animal Welfare?

The ignorance of Americans has let us come to believe that animals have the same moral capacity as humans and therefore they deserve to have their own rights. Well, this is absolutely hilarious to a person like me as I come from a third generation dairy farm. If animals were supposed to have the same rights as us, wouldn’t they also be able to communicate like we do? What many people also tend to do is confuse rights with welfar. Animal rights is the belief that animals have the same moral capacity as humans and therefore can make decisions for themselves. Animal welfare, however, is the belief that animals do not have the same moral capacity as humans and therefore we as humans provide essential care (feed, water, shelter, etc.) to the animals because they would not survive without them on their own. Don’t get me wrong, even as a “farm kid” I know that there are places out there that treat animals badly and that is terrible because that affects our farm as well.

Groups like PETA and HSUS are out to prove that “factory farming” is far worse than “family farms”, however, there sole intent is to abolish any sort of animal agriculture and this includes family farms. What bothers me is people nowadays are so removed from any sort of agriculture and yet they feel they know enough to make decisions based on what they see on TV or read on the internet. I hate to inform those types of people, but they are WRONG!! In a society where bad news makes for good news we will believe anything the media tells us, especially when it comes to something like animals. However, it baffles me how hundreds of people if not thousands of people are killed in traffic accidents every day and there are still people driving their cars. So why when one absurb article is punished about how a cow was beaten before slaughter suddenly cause people to stop eating meat? Has anyone ever thought, “maybe not every plant is like this?”. NO! We immediately go to the negative and assume every plant is like that. Well they’re not!

Anyways, I apologize for my rant but I hope people can realize that “what you see, isn’t always what you get.” So instead of animal rights, stand up for animal welfare because quite frankly you could really kiss our economy good-bye if you take away animal agriculture.

February…Why is this my business?!?!?! Excuse me but I have been around animals my entire life!!! So yes this is my business! Why are people who have no exposure to farm animals taking business in an area in which they have no expertise? Yes, there are changes that need to be made but the extremes to which these changes are being made are going to put the American Farmer out of business. And let me remind you, MOST farmers actually care about the well-being of their animals but just because of a few bad eggs everyone assumes that all animal agriculture is bad. DO NOT tell me this is none of my business!!! Why don’t people mind their own business and let the farmers take care of their animals.

And when I say welfare I mean the well-being of the animals. NOT giving them money!

I was watching some raw photos of a car accident in Brazil, 2 male friends died because of alcohol and speed..

Like any other young person that has the bad luck of finding those images over the internet or just because a friend passed the link to watch how raw can an irresponsable accident no matter what type it was make me feel weak and empty phsically, emotionally and spiritually, I accept watching horrendous killing images, animal massacre, accidents and murders by accident or just because someone passed the mail worldwide. but what I saw was completely something I would not imagine could happened to a human body, even the soul, 2 friend in Parana Brazil, with high levels of alcohol crashed but what comes along the accident is the remains, completely distubing, from neck to toe everything was intact but from the neck to the top it was completely unbeliavable and sad to my eyes, 2 young men just like me on the road.
Makes me meditate about material things that at the end are worthless, I think of friends, family and people out there acting
so wildly?
I’m scared and spiritually weak :-(

Car repair estimate. Photos included. Is the other driver trying to milk me?

I got in a car accident on Feb, 11th. Here’s what happened. It was raining and my car couldn’t stop all the way at the intersection so it slid past the red light. The other driver, coming from my perpendicular left, seeing me slid, decided to speed up to avoid a collision but instead my car hits his rear tire and scratches/dents his bumper. We agreed not to notify the police or our insurance companies. The damage on his car was minor so he said that he’ll just do a wheel alignment and give me a call a week later about repair cost. He called me today and told me the repair cost is going to be $1000. 500 for rims and 500 for the bumper. So I was wondering if I can get it repaired for cheaper. I’m planning on going to the junk yard to find used rims which he agreed to but I still can’t believe the scratch/dent on the rear right bumper is going to cost me $500. We agreed not to contact the insurance company at this point. My 99 corrolla is much more damaged than his “scratches” but the accident is still considered my fault since I hit him. So if we do contact the insurance company, how would would my insurance rise by?
We both have each other’s insurance company and driver’s information. I’m pretty sure I dented his rims because I hit his rear tire. Right now, I’m a student so I’m paying about $300 for a 6 month insurance. How much would the insurance go up by? Would the insurance go down eventually if I don’t get an accident for a period of time? Should I contact my agent? Wouldn’t they want to find out about my accident so they can raise my insurance or should I keep them out of it?

It looks like this guy is trying to take you and bend you over. The rim you can get at a wrecking yard for 75.00. …there isn’t any dent or real dammage to the fender just some surface scratches..
Answer this………..if there aren’t any dents in the side of the truck then how in the hell did the bumper get hurt ? And where is the dammage to the bumper ? It looks like the bumper is bent up from the bottom and BACK……look at the pict ! The bumper no the bottom is twisted IN and it is UP on the top. How could that happen if you hit it from the FRONT and SIDE ? It would have been pulled out and down not up and in !……….AND what in the hell are you paying so much money for insurance for if you aren’t going to use it ?!!! Think guy 1,000 is a year and a half of insurance at your current rates.. You got that kind of money laying around? USE the insurance !

My hubby was in an accident a couple of days ago. His car is mangled and he is suffering from back pain. After accident he went to the ER to be checked and was fine as far as they could see. He wants to file through the driver at fault’s insurance so not to raise our price. The police did not let him get his insurance info so we are waiting for the report. What happens now?? What do we do?? Will they offer a settlement and how soon??

Depending on the state in which you reside, you can go to the police substation and pick up the report (some states you have to go pick it up). The officer should have given him a case or incident report number. Good you have a medical document, bad it says he was fine. Did the other driver get ticketed at fault for the accident. Some states are ‘no fault’, so regardless who is to blame, both file with their own insurance. Then, the insurance companies hash it out between themselves. Sounds like you have at fault. Call your insurance company to get involved in the process. They are going to handle the case anyway, but you should stay on top of what transpires. In some instances, neither insurance company will accept fault and the case can go to trial. Your husband will be called to testify and if the court determines the other driver is at fault, your husband could be awarded a settlement and/or payment for damages to his car. Like I said, I don’t know where you live, so go online to the DMV (be careful, there is a non-governmental website listed as ‘DMV.org’) in your state. You should be able to find definitive information on auto accidents, insurance issues, etc. There.

Depends, is GEICO your carrier or the other persons?

If GEICO is your carrier, it’s pointed out in your policy which is probably as soon as possible. The only legal time limit is the Statute of Limitations for contracts in your state (probably not less then 2 years). BUT, a delay can cause problems.

If its the other person’s policy, again, the same items apply but the Statute of Limtations time frame would would be different.

In both cases, you still want to make the report as soon as possible. Delays can _only_ cause problems.

If i’m rear-ended in an auto accident, the other driver is at fault and their insurance covers my rental. are there any limitations as to what the insurance covers? will i be responsible for the damage waiver and so forth?
i was actually asking who pays for the insurance on the rental car.
i’m not young. the other driver was proven to be at fault.

The person who pays for insurance on the rental car is the person who is renting the car. If you are in a rental due to an accident, the insurance company is only required to provide you with alternative transportation while your car is being repaired. They have no legal requirement to pay for insurance because you elected not to purchase comp/collision or liability insurance for yourself OR if it’s a situation where your own insurance policy doesn’t transfer to a rental.

I had a small accident in September, and by just bad luck, my insurance was cancelled(for like 10 days between payments), so I want to present a case to get my car back in shape.

The other party did not report the accident(although I reported mine to my insurance agent)

Depends on your state and if it is a “No Fault” state. In which case, if the majority of fault falls to the other party, you can generally only sue up to $500 to cover deductible (Which is why some people care Mini-Tort on their insurance to cover this if a judgement is made against them). Also, if insurance is required in your state, then you may not want to go down this road since you would end up incriminating yourself by admitting you didn’t have insurance in the first place at the time of the accident.

I have parking violation as a conviction of my driving record in Nevada. Will that show on my MVR?

I was cited for an accident but I went to traffic school and it was amended to a “parking violation”. Will it show on my Motor Vehicle Report?

If it doesn’t and you look like a liar for not disclosing it just put a note that you had an accident at one point but it was dropped to a parking violation by a result of negotiation or whatever and you’ll be fine.

Insurance company will not pay for car accident even though i was insured. What Are my Rights?

I was involved in an accident a year ago. I had liability insurance i paid every month for 6 months up until the accident. When the insurance company investigated the accident they said that they were not paying for the damages of the driver in the other car because i failed to mention an accident i was in upon purchasing the insurance. To my knowledge it is illinois law for the insurance company to do a motor vehicle report within 48 hors of the policy. They should have seen the accident their and either refunded my money then or made changes to my premium. I am being sued for $4000 now my lisence if suspended and im in andout of court every other week paying thousands of dollars in fines. And the company kept the hundrends of dollars i paid them every month. I tried contacting department of insurance and they arnt any help. Please help me.

You should refer to your policy. Read the part that states they have the right to deny payment if you provide them with false, deceptive, misleading or incomplete information on your insurance application. However, this is usually limited to optional coverages. In most states, the insurance company cannot deny the compulsory liability limits. You MAY need to hire an attorney, but call back and ask to speak to a supervisor. They should have sent you a formal denial of coverage letter citing the policy language that allows them to deny coverage.

How do I deal with this hit and run accident?

Here is my situation: My car was sitting in a store parking lot when a woman lost control of her car and hit mine doing major damage to my car. The woman then fled the accident in her car. The city police came out and did a report. The report was as basic as can be and even though there were multiple witnesses the officer didn’t take any statements nor did he request a copy of the stores surveillance video that clearly showed the accident. On this car I only carry liability with uninsured driver coverage. My insurance stated they will pay for my car if they have “significant identifying information” when asked they said video of the car that did the damage or a witness statement describing the car. The only identifying information in the police report is the color listed as “black” but the transfer onto my car was white. The chief of police will not assist me on this or even return my calls. What options/actions should I take to take care of this situation? What would you do if this was you? Why do you think the officer did such a poor job on the report? Why do you think the chief won’t talk to me? I have been about 7 weeks trying to take care of this situation.

A hit and run with property damage is a crime in the state of Indiana (and most other states). So the officer is required by law to investigate a crime. I should have taken reports myself, but I trusted the officer to do a good job. I made a mistake. I know that now. I don’t need people to tell me what I should have done or that the officer shouldn’t have done something. I need advice on what I should/can do now.

I am out the cost of my car. I have made it drivable but it is not right. I have already talked to the insurance company and had the damage assessed. They are going to pay for a replacement car but only if I can get information to them. What might I do to get more info. I’m thinking of creating a webpage asking for any witness to the incident. I’m also thinking about pointing out that the police did substandard job on the report. I think the officer did a bad job on purpose because he either knew the person or because he found the person and was paid to protect them.

For “Who aren’t you”: The store states that they only release security video by court order or to the police.
For “Billy Bob”: So you are saying, as a retired cop, that the cops are worthless to all of us that aren’t more powerful than them? Aren’t they here to “serve and protect” or should we say that they are here to “Serve and protect other cops (and rich people)?” You may be right but I hate to think that these guys that hae so much power and can do such damange in my community are only here to help themselves and not the rest of us. I’ve been involved with public service for about 13 years now and have had to count on cops to cover my back more than once, and now you are saying that they won’t unless it is to there benifit? Damn if I protect (or save) one in the future then.
If I read the “law” correctly they are to investigate any crime committed. Since a hit and run is a crime (class b misdemeanor in Indiana) and since the law requires them to investigate any accident with damages of more than $1000 (my car was totaled and replacement is about $3,800) then yes it is their place to do that job. That is how they follow AND enforce the law. I plan to hold them to it. I was hoping someone here had an idea on how to make that happen, but the no one has any real advice, just telling me I’m SOL doesn’t help.

My agency no longer investigates a private property crash unless an injury is involved.
- Just for comparison case it cost’s our department about $500 to issue a traffic ticket
- It costs about $2000 to arrest a DUI driver
- It costs between $1000 – $15000 to investigate a traffic crash (the $15,000 is a dui caused fatal crash where felony charges are going to be filed against the dui driver).
- Between 1982 and 2012 our population has doubled and the police force has decreased by 1/3

Most traffic crash investigations do not involve interviewing witnesses (unless it’s serious or injury). The sad thing is that witnesses are notoriously unreliable and give vastly conflicting statements.

The chief probably receives 10-20 complaint calls a day from people like you. He then tallys up the total complaints by categories and presents it to the city council or state legislature. However, with the budget problems it is unlikely that he will receive any reinforcements.

The best trained police officers are a hot commodity and are hired by departments with better tax revenues. The other departments get to hire fresh recruits without much training or law enforcement experience.

The sad thing is that if the police catch your hit and run driver – I’m willing to bet he/she has a suspended driver’s license and no insurance. We have found about 40% of the drivers in my area do not carry insurance as the law requires. If they are caught, and if they are convicted their license will be suspended. However, our county court is funded to try only less than 1% of all criminal cases that are submitted by the police. They reserve much of the court time for domestic crimes and crimes of violence. Drug and traffic crimes are rarely prosecuted.

Sorry, I wish I had better news for you. My vehicle is paid of and has 120,000 miles and I still carry full coverage for this very reason.

You might be able to file a civil subpoena for the video camera. In my experience about 90% of the video recordings are of such poor quality they are actually useless. It takes expensive software to pull any kind of detail from the video (and the time of a high paid technician). Many of these stores only retain the video for 7 days. In some cases perhaps 30 days. Storing the video also takes time and money.

7 weeks is way too late to do anything. If you really wanted to make a difference you could ask the city council to increase the funding for the police. You probably pay about $20 a year for police service. Just adding a $1 or $2 would make a huge difference.

You could put up a web page to seek tips. Again the vast majority of tips are useless or prank tips. It would take you a great deal of time to run them down and verify them.

There are so many free wav files on line with most if not all of these sound effects. There are cheap cd’s loaded with sound effects.
To do some of these your self is get a real good recorder (digital would be ideal) an get the sounds yourself. Do you know anyone with a baby?

Siren, check with your local EMS department… When they test the lights and stuff they might let you record the siren, don’t forget to record the air horns too

I think your best bet would be to help the reader visualize the effect of whatever strikes the windshield has on the glass. If your reader visualizes the damage being done, their own memory of breaking glass will form in their mind. You won’t be required to come up with the sound it makes. Think of watching an action movie, the hero falls from the second story window and lands on the windshield on his back. What happens?

Ok its sounds complicated but its really very simple…
When a car crashes (on your side of the road) a light on your dash board comes on to warn you. -thats the basic jist.. It does this by means of a radio transmitter/reciever in each vehicle.

WHAT I WANT TO KNOW IS: can the cars receiving the warning signal from cars DECIDE whether to omit or accept the signal based on what the Dopler effect is telling the receiver about whether the crashed vehicle is getting closer or futher away?

Further over i guess im asking if the receivers could be made SENSITIVE and RELIABLE enough to accurately decipher the approach or retreating of the crashed vehicle in a way that would be good a safety system on the road (like the one described).

Say what should I charge a Personal Injury Lawyer for a semi-pro and yet tad cheezy :60 second TV style commercial to go on his website. It’s a film style recreation that is well executed, fake car crash, music, sound effects, cheezy voice over, creative editing with filters and graphics. It took effort and some time say 16 hours to create and polish and even more to make changes. I used Sony vegas 9 and am providing it as a .wmv file and was very careful to not violate any copyright laws.

I hit their trailer hitch, so my bumper is cracked and pushed back into my car, and rotated about 45 degrees downwards. I think I punctured the radiator, because all my antifreeze leaked out.

It might, it might not. Worse, he might not have any insurance.

Police, and police reports, do not determine fault – they only offer a non-binding opinion.

His insurance has NO obligation to take a claim report from you – if he has it.

Best case scenario, you’ll hear from his insurance company tomorrow. Worst, he’s not insured, and you’re on your own for the damages.

I had a very small car accident. I was just going to pay for it and get it done with. I turns out there in over a $1000 and he is going to fill out a police accident report.

I was driving my dads car and was not planing on telling him about this but will the police call and let him know that is car was in an accident?

I am sorry I should have been more clear with my question. There was no damage what so ever to my dads car. All damage is to the car I hit. I have allready workes it out with the guy I hit that we are NOT going through insurance, I am just going to pay him out of my own pocket.

Need serious advice on an auto accident settlement, lawyer is giving vague answers to me, not really helpful..?

Had a very bad car accident summer of 2007. Have had shoulder surgery for a torn rotator cuff, have had surgery on each arm for nerve damage due to compression from impact onto steering wheel, still having neurological issues from 5 herniations in my cervical spine. C2, C3, C4, C5, C6 are all severely herniated, C4 and C5 are pinching into my spinal column and I am experiencing periodic numbness in my body, not loss of control of my body but just a pins and needles feeling in parts of my body from this herniation. I am going to have neck surgery because of this, surgery is set for march of this year…The driver that hit me ran a red light and sideswiped me. She is a highschool student that lives in her parents house…she is 18 and lives in her parents home because she was going to be a senior in highschool that fall….my lawyer called and told me he has recieved a call from the girls parents insurance company, whom she is insured with under her parents policy…they have a 50,000 policy…the insurance company have offered the full 50,000 and want her to settle. I asked the lawyer what my options were because I have such devistating injuries, can I go after their assets, or home owners insurance beings she was a driver under the parents and they dont have low insurance…they own a 430,000 dollar home, the father drives a 50,000 truck, the mother drives a new caddillac escalade, he owns a large trailer that hauls vehicles…the trailer is very valuable, over 20,000 dollar enclosed trailer. the lawyer says that I can get the 50,000 policy and cant go after homeowners but my question is, I am told that when a child of a parent is living in the home and driving, a parent should have an umbrella policy in case the child driving causes a devistating auto accident that results in severe injuries, so they cant lose their home….my lawyer seems really eager to settle this case and I haven’t even had my neck surgery yet…he says my own insurance PIP that I have will cover all surgeries that I need and give me all the medical care that I still need until I fully recover, but I am very angry and extremely upset because my injuries are worth way more than 50,000 dollars minus the lawyers 1/3 fee…I have had several surgeries and I am going to have a fused neck because of surgery that is needed, and my neurological health is still at risk…I want to know my options, I am afraid to go to another lawyer to ask advice but I need to know what I should do so I don’t screw myself out of compensation…I live in northern new jersey and I want to know if anyone knows what my options are….can I get the 50,000 off of their policy and then file a civil suit in court against them and go after all of their assets and when I win in court because she is found to be 100% negligent because she ran a redlight and hit my car at a high rate of speed 60 mph side impact…when I win would they be ordered to pay by a judge and all of their assets, including their home or whatever have a lein put against it??? I dont want to come across as a snake here but I am really in a bad position because I am permanately disabled from this accident and lost a career and a large part of my life as I knew it and I dont want to settle this out for peanuts….thanks..
just looked at all paperwork and girl that hit me was NOT 18…She was only 17 at the time of the accident. I would say your lawyer is a sleaze — some criminal lawyers often used to do this when they were paid from the public purse — they told all of their clients to plead guilty. Until the system was changed, this way they got 10 clients to plead guilty in about 50 minutes and got 10 day’s worth of fees for doing no real work.
In this case, your lawyer is assessing that if he puts in more work, the settlement amount may go up, but his marginal return will be far lower for the amount of time he puts in.
I can’t say for sure though…
It may legitimately be that there was no umbrella policy for the parent’s insurance – definitely INSTRUCT your lawyer to have a look at the parent’s policies and INSTRUCT him to explain everything. He works for you, even if he is on a contingency. If there is anything you don’t understand, crawl up his ass until he has explained it properly and look at the documents yourself as he explains them.
Also, I suspect you have, but if not, begin the court proceedings so the limitation period is saved.

Re: going after parent’s assets, I’m afraid that you can’t do this unless you can prove they were negligent in some way. If the girl has any savings, though, you could go after those (and any value left in her car).
…but, although not legally required, If the parent’s are loaded they will pay the excess rather than leave it on their daughter’s record that she is a judgment debtor – if you take this to trial and win, that will follow her until bankruptcy or she’s rich enough to pay you off from her own pocket but that could drag this out for years/decades.
But yes, if your lawyer doesn’t straighten up, consult someone else, even for a second opinion.

Or do lawyers usually only have other lawyers represent them in criminal or ethics matters?
I know he could represent himself in a civil damages/personal injury claim, but would a lawyer normally? Like mentioned above, he could represent himself in a criminal proceeding, but that seldom happens, even if a criminal specialist themselves.

It is very hard to be objective in court when you are the plaintiff or defendant.

“A person with himself as his lawyer has a fool for a client.” That goes for lawyers as well as the general public.

Do I need a lawyer if someone caused an auto accident but I was not injured?

I was recently in an auto accident caused by someone else running a red light. I plowed into them as I went into the intersection. It was my first accident and there were a few things I failed to do at the scene, but the authorities pretty much handled all the info. I also did notify my insurance company right away. Anyway, the other party was very quick to argue that I ran the red light and said she was injured and was hauled off in an ambulance. She wouldn’t even talk to me except to argue that it was my fault and rolled up her window. I also believe she was on her cell when she ran it, but can’t prove it or anything, except that it was already up to her ear after the impact. The other thing that stinks is that all the people sitting in their cars at HER red light she ran never stuck around as witnesses. I did have a passenger in my car who does agree my light was green. Anyway, I wasn’t hurt, the front end of my car is wrecked and now leaking oil. I wasn’t at fault and am afraid that, without witnesses and because she was injured, she’s going to come after me in a “he said, she said” battle. Do I need a lawyer? Every time I search for car accident lawyers they always come back with “personal injury attorneys”. I am not injured, so what do I do?
There is no police report as of yet and no one got cited at the scene. People I spoke to about the citation thing were confused as to why no one got cited (and being my 1st accident I wouldn’t know either), but one person told me it was possibly because the police have a way of checking to see who was at fault. Possibly with cameras at the intersection? I nor my passenger didn’t notice any there though.

You will probably be making your case to an insurance company, not a court of law, so you don’t need legally perfect “proof” of anything. You’ll be negotiating informally with the insurance company through letters and phone calls with an insurance adjuster. You just need to make a reasonable argument — in plain language — that another person was careless (“negligent”), even if there are also plausible arguments on the other side.

For example, in a car accident case, you do not need to present measurements of tire marks or precise angles of collision. Just point out that the other driver ran the light, and where the damage to both cars is. Common knowledge of driving rules tells both you and the insurance company who was at fault.

If you make a good argument why the other person was at fault, the adjuster will realize that if the matter wound up in court, there is a good possibility that its insured person would be found legally responsible. Companies usually prefer to pay a reasonable claim settlement sooner, rather than risk having to later pay not only for your injuries, but also court costs and lawyer fees.

I was in an auto accident recently and a friend was involved. I lost consciousness after the airbags deployed and didn’t remember what happened. I was found at fault for following too closely. The friend told me everything and since I told her I wasn’t getting a lawyer, I guess she spilled the beans. I feel like this situation is unfair because now my car and another car are totalled. She told me things that were not told to the police like why her kids left the scene(they were not seated properly didn’t want a ticket), she was in a rush to get where she was going, the car in front of me was all behind her car, which caused me to slam on my breaks. The 2nd car was really at fault but I got ticketed.

I agree with the person above me that having a person with you when you drive. It’s the best thing you can have for any of these. Here are some more ideas though.

For A: Do not drive when you are sleepy or worn out. If you get really tired, pull over and walk around. Drink something with caffeine or eat an apple (apples wake you up faster than caffeine). Listen to the radio while driving and sing along. Turn on the air conditioner or roll down the window.

B: Pay attention to all speed limit signs. Make sure you have no distractions when you drive, such as changing cds or texting. Be aware of your surrondings, such as construction, weather, or accidents, and adjust speed accordingly.

C: NEVER let anyone who has been drinking drive. Have a designated driver or call a cab service. There are certain cities that offer after hour rides if someone has had too much to drink.

D: Practice driving in an empty parking lot or anywhere with not a lot of traffic. Practice driving during times where there is not a lot of traffic to get used to the road and road signs. Get someone who has had experience to ride with you.
