Helen asks…

What happens in a car accident of this nature?

I was in an accident, i (person A) am driving a vehicle that i do not own, the owner (person b) however has lability and full coverage to top it off.

I also have liability and full coverage to top it off, but that car is not listed on my policy, because i dont own it.

Now lets say i get into an accident and need to pay for damages to other objects (well just say person C), as well as for the vehicle i crashed.(owned by person b)

WTF?

admin answers:

In Texas, liability follows the vehicle. Assumption: you have the permission of B to driver their car. If you hit person C while driving Person B’s vehicle, B insurance will be responsible for the damages. If that policy is not substantial enough to cover the damages in full, your insurance will be excess and pick up where B left off. B’s insurance will pay to fix B’s car, subject to the deductible.

Carol asks…

What happens after a car accident involving no other cars and no injuries?

If you hit a snow bank, for instance, and there is no damage but a tow truck has to pull you out – what happens? Do you call the police? Do the police come if no one was injured? Do you get a ticket? Would you get some sort of written proof about the accident? Would they pull out your car and let you go on your way?

admin answers:

In this example, if there was no damage and no injuries, there is no need to involve the police.

In the case where there is damage to the vehicle, it depends entirely on where the accident occurred. In some states and provinces, damage over a particular dollar amount (no matter the reason) requires that you file an accident report with the police. This is true for most Canadian provinces at least. You may also be required to contact the police immediately, and they will decide if someone needs to be at the accident scene before the vehicle is removed.

In locations that require an accident report, they will give you a copy of the report and possibly a special temporary sticker to affix to the vehicle with the accident report number and an indication of where the damage is located. Those are then required by the repair shop so they can repair the damage. Without them, a reputable shop cannot and will not fix the damage.

Again, the rules around this vary in the different states and provinces. If there is damage, the prudent thing to do is call the local police (although don’t use 911, its not an emergency) and ask them what the next steps are.

How to find out any infromation about a car accident?

A friend of mine had a friend who passed away due to injuries that substained in a car accident. How to get infromation about the auto accident? Family gave no info about where, when, who, reasons that the accident may have happened. Are there car accident reports for the public to see?

admin answers:

You could try your local police station or local newspaper office…i doubt very much if they would give out hat kind of info to someone that is not a relative…might be worth a try though.

Sandy asks…

I was in a car accident a week ago with a rental car driver that was at fault. What are my options?

My accident was a week ago today and I still have no answers and more importantly no car. There is a question with the rental agreement with the driver of the car and the person that rented the car. The rental car company is Hertz and there insurance company is Traveler’s. What can I do to be compensated for this run-around and huge hassle?

admin answers:

You need to file this claim with your policy. Travelers has no duty of good faith towards you. If the person driving wasn’t the named insured on the policy (if they were only a listed operator), then the Travelers policy won’t carry over onto the rental, anyway.

Then you have to sue that driver in court to be compensated.

So take care of your car on your own, because the lawsuit thing can take months and months to happen. Oh, and if you do this through YOUR insurance, if you have collision coverage, your insurance company will chase the money down for you. If they can.
